Mr. Miller comments that a significant portion of these real estate malpractice claims often have little to no merit and take time to materialize. “Attorneys accused of malpractice can expect to spend a lot of time and money defending themselves,” says Mr. Miller.
Real estate malpractice claims can run the gamut from a client who is upset that their lawyer mishandled a foreclosure defense to errors in large real estate transactions.
With more than 20 percent of all claims reported in the last three years occurring in the real estate field, Mr. Miller comments, “I don’t think we’ve seen the last of it. I expect that it will be in the top one or two for the foreseeable future.”
